姑且不論這樣的作法對於建構台灣本土法學理論與思想是否適當，若只是為了敷衍或者甚至是欺騙台灣民眾，而亂引用德國法規定，甚至是捏造扭曲德國法規內容，那麼事情可就不是這麼簡單了。
觀察歷史的過往例子，特別是一次大戰後的德國威瑪共和，這個共和曾是民主的典範，但最終還是從自身的民主選舉中，產生了最邪惡的納粹帝國。 有人說，台灣根本不能跟當時的德國威瑪共和相比，因為台灣相對更為弱小。如果觀察當時被國際強權所出賣的奧地利，可能更為適切。1938奧地利總理 Kurt von Schuschnigg與希特勒會面。希特勒強迫奧地利納粹黨加入奧國內閣。會面後，奧總理決定在兩日後奧國舉行『防禦性』公投，決定是否與德國合併，嘗試抵抗納粹。然而，當天德國防衛軍就進駐奧地利，沒受到任何抵抗，反受許多奧國人歡迎。總理辭職，並被納粹黨囚禁，在1945年美軍打垮德軍、進駐奧地利後才獲得釋放。
一開始的時候，老德國人似乎沒有什麼人會想要認同綠黨，但是隨著年輕世代的成熟與老化， 權力的鐘擺，逐漸的擺向這一些對抗既有體制的綠黨。以永續發展做為人類下一代能夠生存下去， 取代階級鬥爭，綠黨成功的在德國，也讓戰後的世代， 不見得一定要朝向市場經濟的發展方向作為自己唯一僅有的人生價值。 從社會公平正義的主張，發展到環境保護，讓集體認同從經濟成長轉換成為環境保護， 成為新的集體文化，德國綠黨也寫下人類治理社會的一類新理性。
八国集团(G8) 的第33届峰会，于6月6日至8日在德国的海利根达姆(Heiligendamm，座落于德国北部大城市罗斯托克附近) 召开。一如往年，伴随着G8峰会的举行，是民间社运在场外的激烈抗议行动。 G8 (之前是七国集团G7，俄罗斯于1998年加入这个富国俱乐部) ，是1973年石油危机的副产品。三十多年后，这个关注富国集团利益的“俱乐部”再次面临全球能源政策的危机。在经济上，G8国家仍然扮演着举足轻重的角色，尽管它们只“代表” 世界人口的14%，但是以国内总产值计算却等于世界经济的三分之二。在G8国家之中，只有俄罗斯不在世界银行2006年十大经济体排行上，近排名第14 位。值得注意的是，中国和巴西两个“发展中国家”挤身在十大以内(分别排行第4和第10) ，甚至印度也以排名12超越俄罗斯。 G8是当前新自由主义全球化的大玩家，配合世界银行、世界贸易组织和国家货币基金等国际金融机构拔刀相助，帝国主义继续在全球范围肆虐。 G8来临之际，主办国德国的政府大事动员保安部队，海陆空驻扎在海利根达姆。尽管德国警方戒备森严，还是有逾8万人涌向G8会场，进行反G8抗议示威。抗议G8的示威群众，有环保人士、反战组织、工会份子，以及争取移民权益活动份子等。德国的左党(Die Linke) 也动员参与了抗议示威。德国左党结合了来自推出德国社民党(SPD) 的活动份子、激进社会主义者，以及来自前东德共产党演化出来的民主社会主义党 (PDS) 。 德国警方粗暴地对抗议G8示威者进行镇压。单是6月2日G8召开前在罗斯托克举行的抗议游行，就有逾百人被逮捕，以及很多人在警民冲突中受伤。 当G8 每年例行公事地举行，G8领袖们继续为帝国主义者和资本财团开路护航之时，世界各地贫富悬殊的问题愈来愈严重，中东战火继续燃烧，全球暖化威胁着地球的未来。反对G8霸权的民众，为了争取和平和公义而在场外进行抗议，但是G8的领袖们是不会理解世界人民的不满以及所追求的理想社会。如果不是由下而上地改变现有体制，我们就没有其它选择了

The second day of blockades has started, since the early morning hours thousands of people have been on the streets, many in smaller groups, attempting to reach the fence and blocking all gates and routes leading to Heiligendamm. While the blockade at one of the gates has continued throughout the night, confrontations are currently occuring at the other gate, with police trying to disperse protesters. As hundreds of G8 delegates arrived in the area on Wednesday, mass blockades interrupted their arrival at the fenced security zone. Thousands of activists blocked most of the routes leading to the G8 meeting venue in Heiligendamm. Over 10,000 people blocked the fence gates and 'breached' the newly declared no-demonstration zone around the fence. In the evening, police violently dispersed one of the blockades, while others were continuing with several thousand people still on the streets. Other activists were protesting in the streets surrounding the Rostock-Laage airport. Late in the evening, more than 1,000 people on three blockades decided to stay overnight.

6th June, we woke up earlz in the mornting, todaz it is supposed to be biggy. the block plans started from 8 in the morning, last night around 3am there were alot of police car outside our camp, the alarm started to go crazy somehow, i manage to sleep in this choas, most people were up and dress up ready for a riot. but it ended up as a false alarm. everybodz was presttz pissed off. the reason we have this alarm, its becuase police are more likelz to be blockling the whole camp before our moves, a few dazs ahead people were building watch tower and trap around the camp. there are a couple wazs to get into the g8 meeting place, first is the main road, there´s also another road that can get in to the meeting place but it takes more trouble to get in, other choice are helicopter and boat maybe(not sure about the boat) we are supposed to seperated into different small groupbecuase thereäs too manz of us, we called this finger split, this is acutallz a stradegy when we trz to break into the police line, we go finger split and gather all together after the line. somehow i knew this is not going to work like this, and it didnt. i was in a blue figer group with a few friends i just met when the next daz i arrived the camp. these people are from south germanz and reallz active in the citz.

德國高中歷史學測一律都是申論題，一般大約都是2-3題，出題範圍很廣，遍及經濟史、社會史、日常生活史、地方史、法制史、科技史、藝術史。考前文化局會公布一個出題方向（Hinweis），考後也會公布評分標準和答案範本。 今年5月11日，德國Thueringen邦高中學力測驗歷史考題，翻譯如下：
德國人不管是學生也好,教授也好, 都很習慣拿著兩孔文件夾, 把所有的筆記, 文件, 帳單, 合約...通通整理在一起, 學校的檔案櫃一定有所有學生從一開始申請到最後畢業的所有資料, 辦理戶籍遷入遷出, 辦理簽證....也都有一疊厚厚的個人資料, 甚至連我的教授那裡也有一疊我的資料, 裡頭包括了每次跟我討論他寫下來的紙張文件, 他幫我寫的信件等等, 剛開始很不習慣他們凡事都用紙張存檔的習慣, 但是生活久了,漸漸地發現, 嗯, 那還真是有必要, 而且是非常必要!!
於是回到選舉，我請求大家再想一次「為什麼支持綠黨」。甚至不論是不是綠黨，為什麼支持某個人，某個黨？你們是用什麼想法參與，或躲避政治，為什麼？你覺得這樣好嗎？你有什麼選擇？有了，又該怎麼做？不用回答以上所有的問題，只要想想，明天做出行動。是支持，反對，不關己事去逛街看電影都好，那都是一種選擇。沒有任何人可以評價其他人的選擇的。 這是一場巨大的政治課，我們有一天都得學會為自己的決定負責。因為比起動員，反省自己更尷尬，也更困難。
