一項調查顯示Google(谷歌)一鳴驚人,打敗了老牌美資可口可樂、通用電氣、微軟公司,躍升為全球最值錢品牌。 國際廣告業巨頭WPP集團旗下研究公司---明略行,夥英國《金融時報》評選2007年世界百強的品牌值,網羅世界3.9萬個品牌並訪問超過 100萬消費者,23日剛出爐的結果顯示國際最大網路搜索供應商Google,以664.34億美元的品牌價登上榜首,排名從06年的第七位躍升至榜首,主因是Google業務高速擴張,知名度提升憑藉網際網路上的口碑相傳,並非依重廣告。

部落客(Blogger)侵害智慧財產權有日益嚴重的趨勢!經濟部智慧財產局表示,近月來每天都會收到部落客起訴判決書,以侵害著作權及公開傳輸權最常見。智慧局表示,由於唱片及電影公司已組成專案小組,每天巡察各部落格有無侵權行為,呼籲部落客們應趕緊停止使用未經授權的影片與歌曲,以免留下犯罪記錄。

blog掛播音樂,對這些唱片公司的市場有什麼影響呢?是怕上網者去下載?還是想逼blogger去拿授權?真不知道他們在想什麼!

這個年頭,PTT各個球隊版開始流行用 PPStream 或者 TVUplayer 來收看境外電視頻道上的球賽…它基本上是「點對點傳輸科技」(peer-to-peer or P2P)的又一項新應用,可以稱為P2PTV。基本的運作方式是,有人在網路上提供 audio-video stream,然後透過P2P通訊協定,所有的觀賞者也同時變成網路上傳輸資訊封包的節點。因此 audio-video 的傳播速度,不再只受限於提供者上載的頻寬。同一時間觀看的人愈多,傳播的速度就愈快,因此可以實現高解析度的即時網路視訊轉播。

It also said the fact that portions of the programs are stored temporarily in "buffer memory" on the company's servers was problematic. Viacom's over $1 billion lawsuit, accusing Google and its video sharing Web site, YouTube, of 'massive intentional copyright infringement' ... The suit alleged... that Google and YouTube allow users upload popular shows, thus threatening to make the video sharing site a major entertainment and advertising outlet. Indeed, Viacom has been YouTube's most vocal critic in all the months of negotiating for payment for the use of its programming by the latter. Up until last month, when the company demanded that YouTube pull down nearly 1,60,000 unauthorized clips of its shows, uploaded by users, and viewed more than 1.5 billion times.

YouTube is not the first site to offer money to content providers. In October 2005, Revver, which like YouTube offers video clips online, announced plans to attach advertising to user-submitted videos and give their content creators an equal cut of the profits.

YouTube這個與上傳影帶者分享廣告收益的點子,可能得對上傳侵權影帶者作點提防,例如不立即發放,以便有時間發現是否侵權;而且發現侵權即不發,甚至扣除其他合法影帶所生的廣告利潤。

法院也認為被告Cooper與Google並不同,一是Google的蒐尋功能有很大的合理使用空間,二是Google的蒐尋是普遍性的資料蒐尋,但被告卻是針對非法MP3作鏈結。

這個案子被告幾乎是明知這些鏈結是違法的,還把它整理在網站上,有意積極幫助侵權行為發生。論以間接侵權責任,並不冤枉。

the documents in question are not patents, but applications for patents which have not yet been granted. Second of all, from my reading anyway, Microsoft is not patenting RSS, but RSS within Vista/IE7. Of course I’m not a patent lawyer, I could be wrong about that. The big mystery is what Microsoft is planning to do with the patents if they are awarded them.

就算微軟只就RSS置入IE 7與Vista的部分申請專利,會不會利用這兩項產品(可能)的廣大佔有率,進而控制RSS技術,有待觀察。
